在教育信息化2.0阶段亟须应用智能技术来推动教育创新。而区块链作为现代信息技术的重要代表,具有对等传输、数据保真、智能合约等技术特性,为教育变革提供了一种可行的技术方案。遵循“技术与制度”的分析框架对“区块链+教育”进行了系统性考察与审思。研究发现,区块链与传统教育的结构重塑及流程再造需求之间存在多重耦合,可促进学习环境再造、教育方式转型及教育管理优化。然而区块链本身的自主性、不确定性可能带来技术隐患,且技术应用不当还会引发数据安全问题、智能合约脱法风险以及数字版权保护诘难。需摆正对技术的认知态度,遵循人的主体性价值,并在此基础上加强法律规制:建立技术风险监管机制、完善个人数据保护规则、构造智能合约制度和优化数字版权制度,从而使“区块链+教育”在法制轨道上规范运行。

In the stage of educational informationization 2.0, it is urgent to apply intelligent technology to promote educational innovation. Blockchain, as an important representative of modern information technology, has technical characteristics such as peer-to-peer transmission, data fidelity and smart contracts, providing a feasible technical solution for educational transformation. In accordance with the analytical framework of "technology and system", this paper conducts a systematic investigation and reflection on "blockchain + education". The study finds that there are multiple couplings between blockchain and the demand for structural remolding and process reengineering of traditional education, which can promote the reengineering of learning environment, the transformation of educational mode and the optimization of educational management. However, the autonomy and uncertainty of the blockchain itself may bring technical risks, and improper application of technology will also lead to data security issues, the risk of smart contract offsets and the challenge of digital copyright protection. It is necessary to correct the perception of technology, follow the value of human subjectivity, and strengthen legal regulations on this basis: to establish a supervision mechanism for technical risks, improve rules for personal data protection, construct a smart contract system and optimize the digital copyright system, so as to make the "blockchain + education" operate on the legal track.
